Peculiarities of criminal responsibility for embezzlement of humanitarian aid during the le-gal regime of martial law in Ukraine

The article analyzes Art. 201-2 of the Criminal Code Ukraine "Illegal use for profit humanitarian aid, charitable donations or free aid", opinions scientists regarding specified were investigated, potential problems that may arise in process criminal prosecution relevant act identified, and it was proposed possible ways to solve them.
 Separate aspects responsibility illegal aid studied by: A. Shevchuk, O. Bodnaruk, D. Kamenskyi, Dudorov, R. Movchan, Kolb, V. Grishko, Z. Krasko, Kryshevych, others. In their writings, have repeatedly emphasized need further research on this issue, because a proper criminal-legal analysis is useful correct qualification when distinguishing offenses against property field economic activity.
 It established amendment Ukraine, allows us carry out both preventive prevention commission offense possibility punishing persons who already committed offense.
 Among existing shortcomings wording offense, following can be identified: 1) an unreasonably high minimum limit, which provides grounds bringing unscrupulous persons; 2) purpose "making profit" debatable, such phrase has so far been used only context actual consequences behavior subject concluded legislator needs disposition clearly define range subjects, thereby making impossible prosecute are not subjects receiving aid.
